MINUTES FOR February 4, 2004

The Barre Town Zoning Rewrite Committee held a meeting on Wednesday, February 4, 2004 at 7:14PM at the Municipal Offices, Websterville, Vermont.

An insufficient number of committee members were present to approve the January 21, 2004 meeting minutes.

Old business:

            Discussion took place on a matter that Mark Scott brought up at the last committee meeting.  Mark wondered if the committee, especially in light of the fact they only have 6 members now, would want to adopt a rule that would allow three members present at a committee meeting to approve the previous minutes.

            The members were supportive of the idea.

            Charlie Woodhams wanted to make sure that the 3 member present rule was only for the approval of minutes and not other business.  Everybody agreed.

To allow minutes of previous meetings to be approved by 3 or more committee members present at any given meeting where minutes of a previous meeting are pending final approval.  This change does not affect other votes that this committee may take and therefore all other committee business must have a majority of the committee members vote in the affirmative for a motion to pass.

Aaron provided the members with another handout listing more uses that staff has come up with and  subsequently defined.    These are a continuation of what the committee has already been given and what they have been working on now for a couple of months.  Tonight the committee is being asked to continue the review of the definitions. 

Recreational/Commercial   

            Athletic Fields (17:17)

            Golf Course (19:20)

Add driving range to the description and common winter sports such as cross country skiing but excluding commercial motorized vehicles.   

            Arcade (26:25)

                        Add indoor to the title and add “a use of building” delete “a use of land”  

            Billiard Parlor/Pool Hall (29:07)

Questions arose about whether alcohol could be served and if so does it need to be specified specifically or is it inherent that this use include a bar serving alcohol.  It was the general consensus of the committee is that a Billiard Parlor/Pool Hall would include the serving of  food and alcohol. 

            Bowling Ally (31:24)

There was discussion at this point about the alcohol and food allowance at the above uses and similar type of uses.  Concern being that while alcohol (bars) are usually considered uses incidental to the main use, how does one prevent somebody from trying to disguise a bar as a Billiard Parlor/Pool Hall when the bar is main intended use.

It was the general consensus of the committee that as long as the above uses are only allowed in zones which allow bars or food service as stand alone uses, then as incidental uses, they would be acceptable.     

            Campground (39:20)

                        Discussion took place about what temporary means. 

Carl mentioned the problems we have had in the past when people claim they are camping on their lot when in reality they are living there.

Chris advised that he has considered that and would like to write something into zoning that defines what camping is and how it relates to private property.

It was decided to add the word commercial at the beginning of the definition. 

            Recreational service, indoor (41:40)

                        Add commercial to the definition.

                        Also add Archery to the list. 

                        Chris advised that bowling and billiard are duplicated here and could be removed.

Aaron thought that maybe we could eliminate the stand-alone bowing and billiard etc. uses and incorporate them into this definition.

Generally the committee thought it might be appropriate to leave it the way it is laid out right now, separate.  

            Recreational service, outdoor (52:00)

                        Add Archery & paint ball to the list of example uses.

The committee had concerns with leaving racing and amusement/special interest from the examples.  In the end the committee generally decided that racing and amusement/special interest needed to be defined separately

            Outdoor firearms range (55:22)

                        Mark S. suggested that the word weapons be eliminated from the definition. 

                        Mark S. suggested that we should also offer an indoor firearms range as a separate use. 

            Outdoor non-motorized recreation (1:01:35)

                        Needs to be defined

            Commercial Professional:

            Private Park/recreational area (1:02:14)

                        Add in “or” after and before recreational opportunities.

            Airport, private (1:14:06)

            Airport, commercial (1:22:28)

            Photographic material (1:23:23)

            Photo studio (1:24:05)

Remove “on a walk-in basis, also including processing of the resulting images as an accessory use”.

            Photo processing facility (1:30:15)

                        Remove “and access is provided primarily by a drive-through facility or walk-up basis”.

            Healing profession (1:35:23)

            Licensed Professional Service (1:37:04)

            Laboratory (1:42:15)

                        Alter definition to sound better                       

            Veterinary Clinic/Animal Hospital (1:46:50)

            Bank/Credit union (1:47:32)              

                        Remove “on a walk-in or drive through basis”.
