NO PARKING 11:00 PM - 7:00 AM November 1st - April 1st each year, regardless of the weather forecast!
Effective November 1st through April 1st of each year, between the hours of 11:00 p.m. and 7:00 a.m., the Town of Barre will begin enforcement of the Winter Ban Parking Ordinance.

Vehicles may not be within the right-of-way of town roads or selected highways regardless of the weather forecast.

If your vehicle is in violation of this ordinance, you will be fined and subject to any and all towing costs.



AN ORDINANCE OF THE TOWN of BARRE
AMENDING THE BARRE TOWN CODE
BY REVISING SECTION 7-26

WHEREAS, motor vehicles parked within the right-of-way of town roads and highways during snow season could hinder the protection of people and property; and

WHEREAS, motor vehicles parked within the right-of-way of town roads and highways, following notice of parking prohibition, could inhibit public activities; and
WHEREAS, Title 24, Section 2291 of the Vermont Statutes authorizes towns to regulate or exclude the parking of all vehicles and to provide penalties for violation of same.
THE SELECTMEN OF THE TOWN OF BARRE, VERMONT, HEREBY ORDAIN:
SECTION 1. That section 7-26 of the Barre Town Code is hereby amended to read as follows:
Sec. 7-26. Parking restricted on roads at certain times; removal of vehicle authorized; penalties.

(a) The parking of motor vehicles, teams, carts, or any other conveyance within the right-of-way of town roads or selected highways in the town between the hours of 11:00 p.m. and 7:00 a.m. is hereby prohibited between November 1st and April 1st of each and every year. The public shall be notified of this section each year by news releases to commence in October of each year. The town manager may, by executive order, prohibit parking at any other times of the year if emergency road conditions exist.

(b) Parking of motor vehicles, teams, carts, or any other conveyance within the right-of-way of town roads or selected highways may be prohibited by executive order of the town manager for non-emergency purposes such as, but not limited to, special events, construction or maintenance, provided the affected road(s) or selected highway(s) are posted no parking in accordance with the following:

If No Parking Period Begins: Then Roads Must Be Posted:
a) From 10:00 a.m. to 8:00 p.m. a) At least 2 hours before no parking time begins.
b) From 8:01 p.m. to 9:59 a.m. b) Before 6:00 p.m.
The temporary no parking signs shall state the time the no parking period begins and ends.

(c) Any motor vehicle, team, cart, or other conveyance parked within the right-of-way of town roads or selected highways in the town in violation of subsection (a) or (b) may be ticketed by a law enforcement officer. Any motor vehicle, team, cart, or other conveyance parked within the right-of-way of town roads or selected highways in the town in violation of subsection (a) or (b) may, when in the opinion of any law enforcement officer or an officer of the fire department, the public safety demands its immediate removal, or when in the opinion of an official of the Department of Public Works, the proper plowing, maintenance or repair of such street, water mains or sewer pipes under such street requires its immediate removal, be removed forthwith pursuant to an order of such law enforcement officer, fire department officer or official of the Department of Public Works. In compliance with subsection (d), the conveyance shall be removed by a towing service designated by the Board Selectmen. All costs for the removal and any expense incurred in securing such conveyance shall be charged against the owner of the conveyance or the person responsible for such conveyance at the time removal is ordered and such conveyance shall not be released to the owner or person responsible for it at the time removal was ordered until all such costs including the parking violation ticket have been paid.

(d) From time to time the Board of Selectmen shall designate a towing service to be utilized by all Town departments. Nothing in this section
7-26 shall obligate the Board of Selectmen to designate a private towing company. Before designating a private towing company, the Board of Selectmen shall receive written quotations from companies interested in providing the towing service. Furthermore, the Board of Selectmen shall be required to obtain from the selected company evidence of insurance, proper towing equipment, and safe storage area.

(e) The fine for violating subsection (a) or (b) shall be fifteen dollars ($15.00) and shall be payable to the Town of Barre. Said fine shall be due in seven (7) days from date issued or before the conveyance is released by the towing company.

SECTION 2. This ordinance shall become effective fifteen (15) days after adoption.
